Back in 2009 this blog reported on the very topic of Workers Compensation insurance, stating that 1 and 5 businesses are breaking workers compensation laws. In my everyday practice, I feel like the trend is still?prevalent?in the construction industry. The main reason being is due to the?exorbitant?price of this insurance on contractors.

Workers Compensation is codified in Louisiana under Revised Statute 23:1021 et seq. There are a?myriad?of rules and definitions within this chapter of the code that would make any contractors head spin. There are a few key items to remember when classifying employees. First and foremost is that there is a presumption of employee status, as seen in La. R.S. 23:1044. This can be overcome by a number of factors which would make the worker, an independent contrator rather than a employee. La R.S. 23:1045 is where the law states that independent contractors and subcontractors are exempt from coverage. Although the price to insure all employees under workers comp insurance is high, the price that is paid if an accident happens to an uninsured worker is much higher. Furthermore, when the insuring companies do an audit at the end of the year of the status, there can be a hefty price tag for improper reporting.

I represent a number of clients who are learning the hard way that companies like LWCC and Louisiana Home Builders?Association?are not fun to litigate against for a contractor trying to make profits. These companies have either in-house attorneys or law firms who handle these cases day in and day out. There is almost no incentive for them to settle claims?because?there is no fear of pricey litigation. As for the contractor, attorney fee bills keep going higher and at the end of the day the contractor can pay double and triple of what they would have if they had properly reported or settled early.

So let this be a warning to all contractors who are trying to push the line when it comes to workers compensation insurance, its just not worth it. Just like fighting any insurance company, even if the insurer is wrong, they will fight to the bitter end to be proven so. Taking an early haircut, so that you can get back to making money in the industry, can be a win-win for your construction company.

New Japan PM Abe says will pursue bold monetary policy

TOKYO (Reuters) - Japanese Prime Minister Shinzo Abe said on Wednesday his government will pursue bold monetary policy, flexible fiscal policy and a growth strategy to encourage private investment.

"Japan won't have a future and won't be able to restore fiscal health without a strong economy," Abe told a news conference after taking office as the country's seventh prime minister in six years.

Abe has pledged to put top priority on beating deflation and taming the strong yen, which are dragging down the world's third biggest economy. He also wants to loosen the limits of Japan's post-World War Two pacifist constitution on the military and has vowed to take a firm stance in a territorial row with a rising China.

Stung by U.N. defeat, Israel approves new settlements

JERUSALEM (Reuters) - Hours after the United Nations voted overwhelmingly to grant de-facto statehood to Palestine, Israel responded on Friday by announcing it was authorizing 3,000 new settler homes in the West Bank and East Jerusalem.

An official, who declined to be named, said the government had also decided to expedite planning work for thousands more homes in a geographically sensitive area close to Jerusalem that critics say would kill off Palestinian hopes of a viable state.

The decision was made on Thursday when it became clear that the U.N. General Assembly was set to upgrade the Palestinians' status in the world body, making them a "non-member state", as opposed to an "entity", boosting their diplomatic clout.

The motion was backed by 138 nations, opposed by nine, while 41 members abstained - a resounding defeat that exposed its growing diplomatic isolation.

An Israeli official had earlier conceded that this represented a "total failure of diplomacy" and warned there would be consequences - which were swift in coming.

Plans to put up thousands of new settler homes in the wake of the Palestinian upgrade were always likely, but the prospect of building in an area known as E-1, which lies near Jerusalem and bisects much of the West Bank, is seen by some as a potential game changer.

"E-1 will signal the end of the two state-solution," said Daniel Seidemann, an Israeli expert on settlements. He added that statutory planning would take another six to nine months to complete, meaning building there was not a foregone conclusion.

About 500,000 Israelis already live in the West Bank and East Jerusalem on land Israel seized in the 1967 Middle East war - territory the Palestinians claim for their independent state.

The United States, one of the eight countries to vote alongside Israel at the U.N. General Assembly, said the latest expansion plan was counterproductive to the resumption of direct Israeli-Palestinian peace talks.

ABSURD

Ahead of the U.N. vote, Prime Minister Benjamin Netanyahu's government had argued that the unilateral Palestinian move breached their previous accords and accused the 193-member world body of failing in its responsibilities.

"The General Assembly can resemble the theatre of the absurd, which once a year automatically approves ludicrous, anti-Israeli resolutions," said government spokesman Mark Regev.

"Sometimes these are supported by Europe, sometimes they are not," he added, alluding to the fact that only one European state, the Czech Republic, had voted against the Palestinians.

Nonetheless, analysts said the vote exposed the gulf that had opened between Europe and Netanyahu over his handling of the Western-backed administration of Palestinian President Mahmoud Abbas, and the depth of EU opposition to settlement expansion.

"The government has failed to appreciate the gravity of the challenge to Israel's fundamental legitimacy in Europe," said Gidi Grinstein, head of the Reut Institute think-tank.

"The Palestinian bid in the U.N. is turning out to be a bigger defeat than anticipated."

In many ways, Israel was caught off guard.

Last week it was fighting Islamist militants in the Gaza Strip, grateful to see much of the West offering support for its determination to stop indiscriminate rocket fire from the Palestinian enclave whose leaders preach Israel's destruction.

The eight-day bombardment ended in a truce that was widely viewed as handing Gaza's Hamas Islamists a PR boost at the expense of Abbas and the Palestine Liberation Organization, who have renounced violence in favor of diplomacy.

The West pumped billions into Abbas's administration over the years to bolster a partner for Middle East peace and felt they had to rally to his support in New York. Before the Gaza conflict, the Palestinians said they would win 115 'yes' votes at the United Nations. They ended up with more.

COURT THREAT

By itself, the U.N. upgrade will make little practical difference to the Palestinians or Israelis. However, the new position will enable Abbas to seek membership of the International Criminal Court (ICC) in the Hague if he wants.

This is what worries Israel.

The Geneva Convention forbids occupying powers from moving "parts of its own civilian population into the territory it occupies", leaving Israeli officials potentially vulnerable to an ICC challenge. Israel says its settlements are legal, citing historical and Biblical ties to the West Bank and Jerusalem.

The Palestinians say they are in no rush to go to the ICC, but the threat is there, putting pressure on Israel to come up with creative solutions to overcome the peace-talks impasse, which the Jewish state blames on Abbas.

"This U.N. vote is a very strong signal to the Israelis that they can't shove this matter under the carpet for any longer," said Alon Liel, former director-general of the Israeli Foreign Ministry. "This is a red light for Israel."

With politicians campaigning ahead of a January 22 election, Israel is unlikely to change course.

Opinion polls suggest Netanyahu's right-wing bloc will win a new term in office. The coalition includes pro-settler parties, and the prime minister's own Likud group appeared to shift to the right in primaries this week, making any land-for-peace compromise with the Palestinians look more complex than ever.

His opponents seized on the U.N. vote, with ex-foreign minister Tzipi Livni, aspiring to become Israel's second female prime minister, blaming a failure of initiative.

"When we do not initiate, we are imposed upon," she said.

Israeli officials say the Palestinians themselves must show they are ready to make the sort of concessions that they believe are needed to secure an accord - such as renouncing any right to return to modern-day Israel for refugees and their descendants.

However, analysts say that with the elections out of the way, the new government will have a period of calm to try once more to end their decades-old conflict with the Palestinians.

"The strategy toward the Palestinian Authority and statehood is likely to be on the top of the agenda of the next government in the winter," said the Reut Institute's Grinstein.

"The outcome of its strategic reassessment may well be active engagement in upgrading the powers and responsibilities of the Palestinian Authority toward statehood, and eventually recognizing the Palestinian Authority as a state."

If E-1 building goes ahead, the chances of talks resuming will be close to non-existent.

Ortiz hits 399th HR as Red Sox shell Jays

BOSTON (AP) - Two months ago the Red Sox hit bottom. Now they're playing sky high.

Boston won its fifth straight series with a 10-4 win Wednesday over the Toronto Blue Jays with six runs in the first inning against a wild Ricky Romero and with the help of David Ortiz's 399th career homer.

After blowing a nine-run lead and losing to the New York Yankees 15-9 on April 21, the Red Sox were at 4-10 and manager Bobby Valentine said, "If this isn't bottom, we'll find some new ends to the earth."

They immediately turned it around with six straight wins and have the AL's third best record, 36-25, since that low point.

"I wasn't sure" that would be the bottom, Valentine said after Wednesday's win, "but I believed it. Things were going so wrong and we couldn't catch a break. ... I think things turned around because guys believed it, too."

Believing and improving, though, are two different things.

"We all knew that that was the cellar and it was not going to get any worse," Cody Ross said. "You still have to go out and play and perform and since then we've been having fun. Our main thing is to win series. We did that here. Now we can go on the road with some confidence and make a run before the All-Star break."

The Red Sox are at their highest point in the standings, a season-best five games over .500 at 40-35. They're tied with Tampa Bay for third place in the AL East, the first time this year they're not in fourth or fifth.

Boston went 7-2 on the homestand, starting with a three-game sweep of Miami, after opening 14-19 at Fenway Park.

"We got off on the right foot against the Marlins and just kept going, scoring runs, pitching well, playing good defense," Ross said.

Adrian Gonzalez had three RBIs and finished the homestand at 12 for 36 to raise his batting average to .296. Mike Aviles drove in two runs as the Red Sox improved to 9-2 in their last 11 games.

Jon Lester (5-5) fell behind 1-0 in the first when he allowed a run-scoring single to Colby Rasmus, but the Red Sox scored all the runs they needed in the bottom half as Romero (8-2) threw 16 balls on his first 19 pitches.

"I'm just embarrassed in myself more than anything. I feel like I let the team down," Romero said. "Right now when I'm missing, I'm missing bad. I'm not even coming close. "

Boston went ahead 7-1 in the second when Ortiz and Ross walked on 3-1 pitches and Gonzalez hit an RBI single.

Jose Bautista hit a solo shot, his major-league leading 25th homer of the season, off Lester in the fourth.

"We're up 7-0," Lester said. "At 3-and-2 I'm going to challenge him and take my chances. ... I'm not going to walk him. I'm not going to give him a chance to get on base and bring up (Edwin) Encarnacion and give up a two-run homer. I'd rather give up a solo shot."

The Red Sox struck back with two runs in the bottom of the inning. Gonzalez singled in one and Aviles doubled in the other.

Ortiz made it 10-2 in the fifth with his 21st homer of the year. His 399 career homers are tied for 49th with Andres Galarraga and Al Kaline. Duke Snider is 48th with 407.

Lester, who was just 1-2 in his previous six starts, retired eight consecutive batters before running into trouble with two outs in the sixth. He allowed a double to Bautista followed by Encarnacion's 22nd homer.

Lester pitched seven innings, striking out four with no walks, seven hits and four runs.

Romero was in trouble from the start. He had averaged 4.4 walks per nine innings this season but walked a total of just nine batters in his previous four starts.

"He never really had a chance to establish any kind of rhythm or any one given pitch to a certain spot in the strike zone where he could go get a strike against a team that can obviously swing the bats really well," Toronto manager John Farrell said.

On Wednesday, Romero left after giving up six walks, seven hits and nine runs in three-plus innings.

He walked leadoff batter Daniel Nava on four pitches in the first then threw two balls to Dustin Pedroia before his first strike. Pedroia doubled in Nava and the next batter, Ortiz, walked on four pitches before Romero started Ross with two more balls.

Ross then singled, loading the bases, and Gonzalez reached on an error by third baseman Encarnacion, allowing Pedroia and Ortiz to score. Will Middlebrooks followed with an RBI groundout, Aviles singled in one run and Darnell McDonald singled in another, making it 6-1.

Notes: Gonzalez has an eight-game hitting streak. ... Toronto, in last place in the AL East, dropped two games behind Boston ... Are you your own worst enemy? Do you find that you waste precious time when really you know that you should be getting on with any important tasks? Do you feel guilty when you finish way behind schedule or perhaps fail to finish at all?

Whilst you are not the only one to procrastinate in life, it?s a negative aspect that has to be corrected if you are truly to complete your goals in life. Worse, procrastination can easily lead to feelings of depression and worthlessness therefore becoming a vicious circle of time-wasting and reducing your chances of success.

Sometimes, just starting any tasks can be the hardest element to overcome but in order to change behaviours that might have been established for a long time, you need to force yourself to get stuck in and get on with anything on that all-important list.

If procrastination is your secret deadly enemy, then consider adopting some of the following:

-Improve your time management by compiling daily to-do lists if you don?t do so already. Write down everything that needs to be completed that day and then mark them in order of priority. Where possible, write your to-do list the night before so that you know exactly what needs to be done first thing.

-Set your alarm so that you get up earlier. Procrastinating first thing in the morning can lose you hours and then you are always playing catch up. An extra hour can make a great deal of difference plus it starts you off on a positive note.

-Watch less TV. You may be surprised by how much time is really wasted through casual absorption of any favoured TV programmes. Make a note of all the programmes that you really want to watch (or record) and then aim to finish all of your tasks before the first important programme comes on. Despite years of predictions about the sky falling one day, only now have a few FiOS customers received letters notifying them that the party's over. What we mean is that starting July 31st, you won't be able to just slide an activated CableCARD into another box, like you can now.

The real bad news however, is that some premium content will now be flagged Copy Once. Although the FCC has always permitted the use of this flag on most content, Verizon has never used it. Essentially that meant that you could record anything you wanted on your TiVo or Windows Media Center PC and copy those programs any which way you'd like. Not only does this break TiVoToGo and other similar features, but it actually breaks Multi-Room Viewing on the Series3. CableCARD FiOS TV customers can tune to channel 131 to see if their TV will turn dark on D-Day (the screenshot above means you'll need to update your activation to continue viewing) but until then, enjoy the free for all copying while it lasts.

Woman with flesh-eating disease to leave hospital

SAVANNAH, Ga. (AP) ? A Georgia woman battling a rare, flesh-eating disease is preparing to be released from the hospital after nearly two months.

Aimee Copeland's father told The Associated Press on Tuesday his 24-year-old daughter plans to transfer Monday from Doctors Hospital in Augusta to an inpatient rehabilitation center. Andy Copeland says she will spend several weeks there learning to move herself after having her left leg, right foot and both hands amputated.

The graduate student at the University of West Georgia contracted the rare infection after she suffered a deep cut falling from a broken zip-line May 1.

Her father says Copeland is "real excited about leaving" the hospital and "just wants a change of venue." He declined to say where she's going for her rehabilitation therapy.

Pinterest Legal Concerns: What is Lawful to Pin? | Social Media Today

A serious problem seems to be emerging in regards to Pinterest and a violation of the legal rights of content creators and their intellectual property. The problem lies in the fact that you can use the work of others to build your own brand without attributing their work to them or compensating them. Just as with posting photographs on your blog without permission, using copyright images for promotional postcards, or stealing another's article and attaching your own name, new light has emerged that reveals pinning photographs as illegal.

For most folks, no harm is intended - they're just pinning their favorite stuff. But there are those with a malicious intent who are happy to take advantage of this legal loophole. The problem is, well, whose problem is it? And should you and your business avoid Pinterest altogether?

The Infatuation and The Truth

If you are a Pinterest lover like me, your first encounter with this social media outlet may have gone something like the following: when my eyes first beheld Pinterest, fireworks gleamed and a gallant, white stead strode in an endless flowering field. It was he, Prince Pinterest, a charming ?little Webpage.? He held the keys to a vast kingdom of homemade, down-home material wants, desires, and dreams. I was seduced. I came to believe he was the very reason the Maker of Heaven and Earth designed Saturday nights and rainy days. Sweet Pinterest, to whom I have devoted all my ?free? time, captured my heart and soul. It even seemed like a captivating social media site for growing a business.

Then, over time, I started seeing some man-made cracks and a possible seedy underside. The following can be found in Pinterest's Terms of Use contract made between members and the site when signing up (and, yes, it is in all-caps in the contract):

" YOU ACKNOWLEDGE AND AGREE THAT, TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE ENTIRE RISK ARISING OUT OF YOUR ACCESS TO AND USE OF THE SITE, APPLICATION, SERVICES AND SITE CONTENT REMAINS WITH YOU. "

This section completely burst my fairy-tale romance with Pinterest. As Kirsten Kowalski, photographer and lawyer and owner of DDK Photography, points out in her article "Why I Tearfully Deleted My Pinterest Inspiration Boards," I or any other Pinterest member are held responsible for images that we pin. If the image we pin has an exclusive copyright and the copyright holder has not given you explicit use of the image for pinning, then you are violating copyright laws.

Legal Responsibility

So, this quote above is all well and good, but really how actionable is it? Apparently, quite actionable. Check out this section of the Pinterest TOU:

" Cold Brew Labs does not claim any ownership rights in any such Member Content and nothing in these Terms will be deemed to restrict any rights that you may have to use and exploit any such Member Content. "

Gonzalo E. Mon in his article "The Copyright Question: How to Protect Yourself on Pinterest" points out that anyone who uploads their images to Pinterest still has complete ownership of them. This means that if a photographer sues you for pinning their photos, he or she will probably win and Pinterest will get off Scott free.

Wait...would a photographer actually sue an "innocent" Pinterest member? Maybe. Kowalski brings up a previous case in which a photographer sues a search engine for using thumbnail images of the photos. The photographer didn't actually win; the Supreme Court ruled that low resolution thumbnails do not constitute a violation of fair use. However, whenever you or I pin images on Pinterest, they are always the full-sized version.

Avoiding a Lawsuit

It seems that Pinterest covers its fair use violations by proclaiming it is merely a ?supplier? and not a ?user.? Interesting. Often, when I ?click? on something that is golden to me on this site, it leads me to the creator of that golden beauty. Then, when I am led, and, if I invest, that is gold for Pinterest.

However, if I am led but choose to just use the golden beauty for myself and not give kudos to the creator, that is a violation. Even if it is just given to a friend (peer-to-peer), it still encourages, enables, and facilitates infringement. If the creator of the golden beauty wants to fight for his rights, he must take the battle on alone.

So, does this mean that everyone should just drop Pinterest? Not necessarily. An individual or even a business can still use Pinterest. However, make sure that what you pin you...

1. ... own the full copyright.
2. ...have explicit, written permission from the copyright holder.
3. ...have made sure it is under a Creative Commons License (meaning you can re-post if not for profit).

In Sum...

The problem here is that Pinterest defers the problem while enabling it. There's just not an equitable way to protect work. Once pinned and shared, the damage is done.

I'll use this analogy in closing:

Imagine you sell picture frames. You pin loads of pictures to your walls of various categories: waterfalls, animals, sports, etc. You attract customers to your well-organized and finely-selected pins who then turn around and buy your frames. But you used someone else's work to draw them to your brand, likely without fully researching whether or not the artist was okay with you using their work.

Is this right? Can Pinterest seriously push this off on the frame seller in the above analogy? One thing we do know for sure is that this will likely be challenged in court - and very soon. In the meantime, protect yourself and your business by pinning only those images that keep you in the clear legally.

Sheryl Sandberg Named To Facebook's Board Of ... - Business Insider

Sheryl Sandberg was just named to Facebook's board of directors, Facebook announced today.

Sandberg is Facebook's chief operating officer and second-in-command to Mark Zuckerberg.

Sandberg has been at Facebook since 2008 and has millions of dollars in unvested shares at the social networking company.

Before joining Facebook,?Sandberg was vice president of global online sales and operations at Google. At least, until Zuckerberg poached her right under Google's nose.

Sandberg now handles all of Facebook's sales and business operations.

MENLO PARK, Calif. ? June 25, 2012 ??Facebook announced today that Sheryl Sandberg, chief operating officer at Facebook, has joined the company?s board of directors.

Sandberg oversees Facebook?s business operations including sales, marketing, business development, legal, human resources, public policy and communications.

?Sheryl has been my partner in running Facebook and has been central to our growth and success over the years,? said Mark Zuckerberg, founder and CEO of Facebook. ?Her understanding of our mission and long-term opportunity, and her experience both at Facebook and on public company boards makes her a natural fit for our board.?

Prior to Facebook, Sandberg was vice president of Global Online Sales and Operations at Google, where she built and managed the online sales channels for advertising and publishing and operations for consumer products worldwide. She previously served as Chief of Staff for the United States Treasury Department under President Bill Clinton and began her career as an economist with the World Bank. She received B.A. and M.B.A degrees from Harvard University.

Sandberg also serves on the boards of The Walt Disney Company, Women for Women International, the Center for Global Development and V-Day.
